Terms of Sale

These terms apply whenever you order house plans, add-ons or design services from Morava Modern. We've kept them as plain as we can. If anything is unclear, ask us at jovancadart@gmail.com before you order; we're happy to explain.

If you buy as a consumer, nothing in these terms takes away the rights that the law of your country gives you.

1. Who we are

Morava Modern is the house-design collection of CAD ART studio, a family design studio in Paraćin, Serbia. In these terms, "we", "us" and "the studio" mean CAD ART studio, and "you" means the person or business placing the order.

Your contract is with:

2. Who can order

  • You must be at least 18 years old.
  • We accept orders from consumers and businesses worldwide, including the EU and the UK.
  • Everything about your order, including these terms, our quotes, invoices and emails, is in English, and the English text governs.

3. What you can order

Plan sets. Every design in the collection is offered in three sets. The Pricing page and each plan page describe what each set typically includes.

  • Study Set: PDF drawings for study, feasibility, budgeting and early quotes. It is not for construction and carries no build license. If you buy the Complete or Studio Set of the same design within 12 months, we credit 100% of the Study Set price toward it.
  • Complete Set: PDF and DWG drawings, with a license to build the design once, on one site.
  • Studio Set: the Complete Set, plus support from the studio: one round of non-structural modifications before handover (layout, openings, finishes), up to 12 hours; questions and answers for your local licensed professional by email or video call, up to 6 hours over 12 months; and a mirrored set on request.

Add-ons. An additional build license, a mirrored set and plan modifications, as listed on the Pricing page.

Custom design. A new design for your site, quoted separately. See Custom design.

3D interior renderings and 360° tours. Visualization of a Morava Modern design or of your own residential plan, quoted separately. See 3D interior rendering.

Developer license. A license for more than one build of a design, by quote.

The exact sheet list for your design is confirmed in writing with your quote, before you pay. Nothing is charged before that confirmation.

Files and software. All drawings are metric. PDF files open in any current PDF reader. DWG files open in CAD software that reads the DWG format; your quote confirms the file details. Areas are design areas as published, in square meters; square-foot figures are converted and rounded.

What plan sets don't include. Structural design and calculations, heating, plumbing and electrical design, energy compliance calculations, a site plan for your land, or any check against the rules where you build. The drawings are not stamped or sealed.

4. What the designs are, and what they are not

Morava Modern designs are drawn in metric by CAD ART studio in Serbia, following Serbian and EU practice. They are not stamped or approved for any location. Before you apply for permits or build, a professional licensed where you build must review and adapt them.

Depending on where you build, that means working with, for example:

  • US: the code your state or county has adopted (usually based on the IRC or IBC)
  • Canada: the National Building Code of Canada or your provincial code
  • UK: the Building Regulations for your nation, plus planning permission
  • Australia: the National Construction Code and your state or territory requirements

Their work usually covers structure and foundations for your soil and climate, energy compliance, heating, plumbing and electrical design, and conversion to imperial units where needed. It isn't included in the plan price.

CAD ART and its designers are qualified and working in Serbia; they are not licensed or registered in the US, UK, Canada or Australia. That's why every Morava Modern design is adapted by a professional licensed where you build.

We can't promise that any authority will grant planning permission, a building permit or any other consent for a design. You're responsible for checking zoning, covenants and easements, the conditions of your site and soil, and the full cost of your build.

5. Prices, currencies and taxes

  • Our prices are set in US dollars and exclude tax. We invoice in US dollars.
  • Prices shown in GBP, CAD, AUD or EUR are approximate conversions for guidance only. You are invoiced in USD, and any applicable taxes are shown on your invoice.
  • The price in your quote is the price you pay for the items it lists.
  • Your bank or payment provider may charge its own fees or use its own exchange rate. Those charges are outside our control.

6. How ordering works

  1. Order request. You choose a design, a set and any add-ons on our order page and send the request with the acknowledgments shown there. A request is not a contract, and it costs nothing.
  2. Quote. We reply within 2 business days (Central European Time) with a written quote. It confirms the exact sheet list for your design, the price in USD and when you can expect delivery.
  3. Invoice. We send a USD invoice, together with these terms and the Plan License. The invoice explains how to pay.
  4. Contract. Your contract with us is formed when you pay the invoice. If you accept the quote in writing before paying, it is formed when we receive your acceptance.
  5. Confirmation. Before we deliver, we email you a confirmation of your order. It records what you bought, the license that comes with it and, where relevant, your request for immediate access to the files and your acknowledgment of what that means for your right to cancel (see section 8).

We may decline an order request, for example if a set isn't available for a design. If we do, nothing is charged.

7. Delivery

  • We deliver files electronically, by email as attachments or a download link, to the address on your order, once your payment has arrived and we've sent your confirmation.
  • If a link stops working or you lose your files, email us and we'll send them again.
  • For Studio support, plan modifications, custom design and 3D interior visualization, the dates in your quote or proposal are our best estimate. If anything changes, we'll tell you promptly.

8. Your right to cancel

For everyone: 14 days while the files are unopened. If you haven't opened or downloaded any files, you can cancel within 14 days of your purchase for a full refund, whether you buy as a consumer or as a business.

Digital files. Consumers in the UK and the EU, and in many other countries, have a legal right to cancel an online purchase within 14 days. For digital files, that right ends once your download starts, but only if you asked us to make the files available straight away and confirmed that you understand you lose the right to cancel once your download starts. You make that request with a checkbox on the order form, and we record it in your order confirmation. If you'd rather keep your right to cancel for the full 14 days, email us your request instead of using the order form, and we'll deliver your files when the period ends.

Services. Studio support, plan modifications, custom design and 3D interior visualization are services. As a consumer, you can cancel a service within 14 days of the contract. If you asked us to start work within that period and then cancel, you pay a proportionate amount for the work done up to your notice. Once a service has been fully performed, you can no longer cancel it, provided you acknowledged this when you asked us to start.

How to cancel. Use our cancellation page, or email us a clear statement that you're canceling. You don't need to give a reason. To meet the deadline, send your notice before the 14 days end.

Refunds after cancellation. We refund you within 14 days of receiving your notice, using the same payment method unless you agree otherwise. We don't charge a fee for refunds.

9. Refunds and remedies

Changed your mind? If you haven't opened or downloaded any files, you can cancel within 14 days for a full refund. Once a download has started, we don't offer change-of-mind refunds, because digital files can't be returned. Your legal rights are not affected: if files are faulty, incomplete or not as described, we'll correct or replace them, and if we can't, we'll refund you. Customers in Australia also have rights under the Australian Consumer Law that we can't exclude.

10. Your license

When you buy a Complete or Studio Set, you receive a license to build the design once, on one site. Copyright stays with CAD ART studio. Your local licensed professional may adapt the drawings for that one build. You may not resell the drawings or reuse them for another build. The Plan License sets out the full terms and forms part of your contract.

11. Custom design, modifications, visualization and Studio support

  • Before we start, we agree on a written proposal with you: the brief, the scope, the number of revision rounds, the schedule, and the deposit and stage payments.
  • For 3D interior visualization, the scope, views, rounds of changes, dates, price and how you may use the renderings are confirmed in writing in your quote before you pay. We show a client's renderings on our own sites only with written consent.
  • We rely on the information you give us about your site, your needs and your local rules. Delays in that information may move the schedule.
  • For sites outside Serbia, we design homes only.
  • We carry out our services with reasonable care and skill.
  • This work supports, and doesn't replace, your local licensed professional. They adapt the design to the rules where you build and prepare the documents for permits and construction.

12. Your responsibilities

  • Engage a professional licensed where you build before you apply for permits or start work.
  • Give us accurate details when you order.
  • Use the drawings only as the Plan License allows.
  • Check the planning, zoning and private rules that apply to your land.

13. Our liability

  • We're responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill.
  • We don't exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to exclude or limit.
  • We're not responsible for loss caused by building from the drawings without the local adaptation described in section 4, or by changes that others make to the drawings.
  • If you buy as a business: our total liability for an order is limited to the amount you paid for it, and we're not liable for indirect or consequential loss, or for loss of profit, business or opportunity.

Nothing in these terms affects your statutory rights.

14. Intellectual property and this website

The designs, drawings, renderings and text on this site belong to CAD ART studio. Renderings are shown unmodified, and some carry the studio's original letterhead. You're welcome to browse, share links and print pages for your own use. Reproducing our drawings or renderings elsewhere, or using them to make competing plan products, needs our written permission.

15. Reviews

We only publish genuine reviews from real clients, with their permission. We never pay for reviews, and we don't remove negative ones.

16. Complaints

If something isn't right, email us at jovancadart@gmail.com with your invoice number and a short description. We reply within 2 business days (Central European Time) and work to put things right as quickly as we can. If we can't resolve a complaint together, you may contact the consumer protection authority in your country or go to your local courts.

17. Governing law and courts

These terms are governed by the law of Serbia. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in the courts there. If you buy as a business, the competent courts of Serbia have exclusive jurisdiction.

18. General

  • We may update these terms from time to time. The version in force when your contract was formed applies to your order.
  • Your quote, your invoice, these terms and the Plan License together make up our agreement.
  • If a court finds any part of these terms unenforceable, the rest stays in force.
  • If we don't enforce a right straight away, we can still enforce it later.
